These Terms govern your use of the EziQuotes mobile app and website (the "Service") provided by Mathew Brunt, ABN 63 689 554 151 ("we", "us"). By creating an account or using the Service you agree to these Terms.
You must be at least 18 years old and able to enter a binding contract. The Service is intended for use by tradies and small businesses.
You're responsible for keeping your login credentials secure.
You're responsible for all activity under your account.
Notify us immediately at [support@eziquotes.au] of any unauthorised access.
EziQuotes offers paid subscription plans purchased through the Apple App Store or Google Play Store.
Billing, renewals, and refunds are handled by Apple or Google under their respective terms. We do not process payments directly.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via your App Store or Play Store account.
Free trials (if offered) convert to a paid subscription automatically unless cancelled before the trial ends.
Prices may change; we will notify you in advance and you can cancel before any change takes effect.
Refund requests must be made through Apple or Google as the seller of record. We can assist with the process but cannot issue refunds directly for App Store or Play Store purchases.
You agree not to:
Use the Service for unlawful, fraudulent, or misleading purposes.
Issue quotes or invoices on behalf of a business you don't have authority to represent.
Reverse engineer, decompile, or attempt to extract source code.
Upload malicious code, scrape, or overload our systems.
Use the Service to harass, defame, or infringe the rights of others.
We may suspend or terminate accounts that breach these rules.
You retain ownership of all content you create in EziQuotes (quotes, invoices, customers, logos, etc.). You grant us a limited licence to store, process, and display that content solely to provide the Service to you and sync it across your devices.
You are responsible for ensuring your content (including logos and customer data) is accurate, lawful, and that you have the right to use it.
Receipt scanning and supplier item scanning use a third-party AI processor (Rork AI Toolkit) to extract text from photos you submit. Results may not be 100% accurate — always review extracted data before relying on it for tax, accounting, or invoicing purposes. We are not liable for errors arising from AI-extracted data.
We aim for high uptime but do not guarantee the Service will be uninterrupted or error-free. Scheduled maintenance, third-party outages (Apple, Google, Supabase), and force-majeure events may cause downtime.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
EziQuotes is a tool to help you create quotes and invoices. It is not legal, tax, or accounting advice. Consult a qualified professional for those matters.
To the maximum extent permitted by law:
Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.
Nothing in these Terms limits rights you have under the Australian Consumer Law or other non-excludable consumer protections in your jurisdiction.
You agree to indemnify and hold us harmless from claims arising out of (a) your content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
You can stop using the Service and delete your account at any time (see Privacy Policy §9). We may suspend or terminate your account for breach of these Terms, with notice where reasonable. On termination, your right to use the Service ends and your data will be deleted as described in the Privacy Policy.
We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the new Terms.
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of that state, without limiting any non-excludable consumer rights you may have elsewhere.

Apple App Store Provisions
Acknowledgement.
This Agreement is concluded between you and EziQuotes only, and not with Apple Inc. or any of its subsidiaries ("Apple"). EziQuotes, not Apple, is solely responsible for the Application and the content thereof. The usage rules set out in this Agreement must not conflict with the Apple Media Services Terms and Conditions as of the effective date of this Agreement, which you acknowledge you have had the opportunity to review.
Scope of Licence.
The licence granted to you for the Application is limited to a non-transferable licence to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Maintenance and Support.
EziQuotes is solely responsible for providing any maintenance and support services with respect to the Application, as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Warranty.
EziQuotes is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of EziQuotes.
Product Claims.
You acknowledge that EziQuotes, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This Agreement does not limit EziQuotes' liability to you beyond what is permitted by applicable law.
Intellectual Property Rights.
You acknowledge that in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, EziQuotes, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement.
You must comply with any applicable third-party terms of agreement when using the Application, including those of your network provider and any third-party services integrated within the Application.
Third-Party Beneficiary.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
